General Terms of Use
By agreeing to use in whole in part, the “P/T Slider” app, the user consents to the following general terms of use and acknowledges having read and understood them entirely and completely without any restriction or limitation before any prior use. The user undertakes and warrants not to use the app for any other purposes other than those provided by within the hereby general terms of use and legally prescribed.
· Scope “P/T Slider” is intended for professionals in the field of refrigeration, air conditioning, heating and renewable energy in order to assist them in the implementation of the refrigerants.
Information contained in the app are for reference only at the online date or the latest update date.
It is provided in good faith, but should not, under any circumstance, be taken to constitute a guarantee on our part or an assumption of our responsibility. This is particularly the case when third party rights are at stake or in situations where a user of one of our products fails to observe applicable regulations.
For constant improvement, Climalife shall have the right at any time without any prior notice to modify and update any information contained in the app, especially relating to the list of the proposed products.
The app and/or its content shall not constitute any sort of undertaking, express or implied, from Climalife. It shall have no contractual value of any kind whatsoever and shall not imply any kind of commitment regarding selling and buying conditions or regarding the availability of products.
· Intellectual property The user acknowledges that this app is a protected work. All material published within the app, in particular the database including texts and photo, logos, trademarks, and graphics are therefore protected within the meaning and the scope of the French Code of Intellectual Property.
Nothing in these general terms of use shall be construed as granting, explicitly or implicitly, to the user, any right of ownership, licensing, or any kind of title of interest, as well as the use of the app and/or its content. Therefore, any reproductions or copies of the app and/or its content, in whole or in part, which may be made without the consent of the authors or their beneficiaries are illegal.
· Privacy Policy Any personal data that the user might provide to Climalife by using the app shall not be used other than for the purposes of Climalife. They are confidential and treated as such. They cannot be transferred to third parties. In compliance with the French data protection act of January 6th, 1978, you might have the right to access, correct, modify or delete the personal data you have communicated to us. You might exercise this right by sending an email to the following address: contract@climalife.dehon.com, or by writing a letter to Dehon Service, 26 av. du Petit Parc, 94683 Vincennes Cedex.
· Cookies The app may use cookies. These files, which are stored on your support, enable us to facilitate your access to our services. Such cookies do not contain any data that makes it possible to identify the user personally and they are designed to be used exclusively by Climalife.
· Links to other sites Links to other websites that might offer the app are created by companies or persons over which Climalife has no control. Consequently, these sites may record their own cookies on user’s support which visit the app and collect (or request) personal data. Climalife cannot be held liable for the content of these sites and the use which can be made of them by the users.
· Warranties The app and its content are provided for information only. The app and its content shall have no contractual value and shall not constitute a legal advice of any kind whatsoever.
The app and its content are provided “As is” without any express or implied warranty including but not limited to warranty completeness, accuracy, availability, non infringement of intellectual property, warranty of merchantability, fitness for a particular purpose and any warranties arising from course of performance or usage of the app.
· Responsibility In no event and under no circumstances, shall Climalife be liable to any person or entity for damages caused by the app, information included in the app, the use of the app and/or its content made by the user.
Climalife disclaims any responsibility whatsoever in case of unavailability of the app or any of its services. Climalife may at any time and without notice or compensation, temporarily or permanently close the app or the access to one or more services. User expressly agree to disclaim Climalife from any liability and to hold harmless Climalife for any claim, cost and or special, material or immaterial, direct and/or indirect damages or consequential losses however caused by the app, the use of the app and/or its content made by the user.
· Applicable law - Jurisdiction These general terms of use are governed by French law. Any disputes relating thereto, shall be submitted to competent courts within the jurisdiction of the Court of Appeal of Paris.
In case of contradiction, the French version of these general terms and conditions shall prevail over any translation.
